Commission Implementing Regulation (EU) 2024/1748of 21 June 2024amending Commission Implementing Regulation (EU) 2021/1378 as regards the recognition of certain control bodies in accordance with Article 46 of Regulation (EU) 2018/848 of the European Parliament and of the Council as competent to carry out controls and issue organic certificates in third countries for the purpose of imports of organic products into the Union(Text with EEA relevance)THE EUROPEAN COMMISSION,Having regard to the Treaty on the Functioning of the European Union,Having regard to Regulation (EU) 2018/848 of the European Parliament and of the Council of 30 May 2018 on organic production and labelling of organic products and repealing Council Regulation (EC) No 834/2007OJ L 150, 14.6.2018, p. 1, ELI: http://data.europa.eu/eli/reg/2018/848/oj., and in particular Article 46(1) thereof,Whereas:(1)Annex II to Commission Implementing Regulation (EU) 2021/1378Commission Implementing Regulation (EU) 2021/1378 of 19 August 2021 laying down certain rules concerning the certificate issued to operators, groups of operators and exporters in third countries involved in the imports of organic and in-conversion products into the Union and establishing the list of recognised control authorities and control bodies in accordance with Regulation (EU) 2018/848 of the European Parliament and of the Council (OJ L 297, 20.8.2021, p. 24, ELI: http://data.europa.eu/eli/reg_impl/2021/1378/oj). was adopted to contain the list of control authorities and control bodies recognised in accordance with Article 46(1) of Regulation (EU) 2018/848 as competent to carry out controls and issue organic certificates in third countries for the purpose of imports of organic products into the Union in accordance with Article 45(1), point (b)(i), of that Regulation.(2)Article 46(2) of Regulation (EU) 2018/848 lays down the criteria that the control authorities and control bodies must fulfil in order to be recognised in accordance with Article 46(1) of that Regulation. Commission Delegated Regulation (EU) 2021/1698Commission Delegated Regulation (EU) 2021/1698 of 13 July 2021 supplementing Regulation (EU) 2018/848 of the European Parliament and of the Council with procedural requirements for the recognition of control authorities and control bodies that are competent to carry out controls on operators and groups of operators certified organic and on organic products in third countries and with rules on their supervision and the controls and other actions to be performed by those control authorities and control bodies (OJ L 336, 23.9.2021, p. 7, ELI: http://data.europa.eu/eli/reg_del/2021/1698/oj). lays down the procedural requirements to be met by those control authorities and control bodies when submitting to the Commission their request for recognition consisting of a technical dossier.(3)Since the adoption of Implementing Regulation (EU) 2021/1378, the Commission has received requests for recognition, submitted in accordance with Article 46(4) of Regulation (EU) 2018/848, from a number of control bodies.(4)The Commission has received and examined, in accordance with Article 1 of Delegated Regulation (EU) 2021/1698, the requests for recognition from "bio.inspecta AG", "Caucascert LLC", "CCPB Srl", "CERES Certification of Environmental Standards GmbH", "CERTIMEX, Certificadora Mexicana de Productos y Procesos Ecologicos S.C.", "Control Union Certifications B.V.", "Ecocert SAS", "ECOGLOBE LLC", "FOOD SAFETY S.A.", "IMO Control Private Limited", "Kiwa BCS Öko-Garantie GmbH", "Mayacert S.A.", "Organic Control System LLC Subotica", "Organic Standard LLC", "Servicio de Certificación CAAE S.L.U.", "Southern Cross Certified Australia Pty Ltd" and "Tse-Xin Organic Certification Corporation". Based on the information contained in their technical dossiers, the Commission has concluded that it is justified to recognise, for an indefinite duration, those control bodies for certain product categories in certain third countries.(5)Implementing Regulation (EU) 2021/1378 should therefore be amended accordingly.(6)The measures provided for in this Regulation are in accordance with the opinion of the Organic Production Committee,HAS ADOPTED THIS REGULATION:
