Commission Delegated Regulation (EU) 2024/946of 18 January 2024amending Regulation (EU) 2021/2115 of the European Parliament and of the Council as regards Member States’ allocations for direct payments THE EUROPEAN COMMISSION,Having regard to the Treaty on the Functioning of the European Union,Having regard to Regulation (EU) 2021/2115 of the European Parliament and of the Council of 2 December 2021 establishing rules on support for strategic plans to be drawn up by Member States under the common agricultural policy (CAP Strategic Plans) and financed by the European Agricultural Guarantee Fund (EAGF) and by the European Agricultural Fund for Rural Development (EAFRD) and repealing Regulations (EU) No 1305/2013 and (EU) No 1307/2013OJ L 435, 6.12.2021, p. 1, ELI: http://data.europa.eu/eli/reg/2021/2115/oj, and in particular Article 87(2) thereof,Whereas:(1)In accordance with Article 88(6), second subparagraph, of Regulation (EU) 2021/2115, France decided in its CAP Strategic Plan to use up to 5 % of its allocations for direct payments for types of interventions in other sectors referred to in Title III, Chapter III, Section 7, of Regulation (EU) 2021/2115 for calendar years 2024 to 2027. The corresponding amounts are therefore to be deducted from France’s allocations for direct payments.(2)Commission Delegated Regulation (EU) 2023/813Commission Delegated Regulation (EU) 2023/813 of 8 February 2023 amending Regulation (EU) 2021/2115 of the European Parliament and of the Council as regards Member States’ allocations for direct payments and the annual breakdown by Member State of the Union support for rural development (OJ L 102, 17.4.2023, p. 1, ELI: http://data.europa.eu/eli/reg_del/2023/813/oj). reflected the changes in Member States’ allocations for direct payments following the approval of the CAP Strategic Plans, but did not include the changes decided by France for this type of transfer. To reflect that Member State’s decision, it is therefore necessary to adapt France’s allocations for direct payments set out in Annexes V and IX to Regulation (EU) 2021/2115.(3)Annexes V and IX to Regulation (EU) 2021/2115 should therefore be amended accordingly.(4)As the transfer of allocations decided by France concerns the implementation of interventions in calendar years 2024 to 2027, it takes effect as of 1 January 2024. In order to adequately reflect this modification also in Regulation (EU) 2021/2115 and since the amendments made by this Regulation affect the application of Regulation (EU) 2021/2115 from the year 2024, in particular as regards the types of intervention in the form of direct payments, this Regulation should enter into force on the day following that of its publication in the Official Journal of the European Union and should apply retroactively from 1 January 2024,HAS ADOPTED THIS REGULATION:
