Council Regulation (EC) No 207/2009of 26 February 2009on the European Union trade mark(codified version)(Text with EEA relevance) TITLE IGENERAL PROVISIONS
Article 1EU trade mark1.A trade mark for goods or services which is registered in accordance with the conditions contained in this Regulation and in the manner herein provided is hereinafter referred to as a "European Union trade mark ("EU trade mark")".2.AnEU trade mark shall have a unitary character. It shall have equal effect throughout the Union: it shall not be registered, transferred or surrendered or be the subject of a decision revoking the rights of the proprietor or declaring it invalid, nor shall its use be prohibited, save in respect of the whole Union. This principle shall apply unless otherwise provided in this Regulation.
Article 2Office1.A European Union Intellectual Property Office ("the Office") is hereby established.2.All references in Union law to the Office for Harmonization in the Internal Market (trade marks and designs) shall be read as references to the Office.
Article 3Capacity to actFor the purpose of implementing this Regulation, companies or firms and other legal bodies shall be regarded as legal persons if, under the terms of the law governing them, they have the capacity in their own name to have rights and obligations of all kinds, to make contracts or accomplish other legal acts and to sue and be sued.
