Council Directive 2004/84/ECof 10 June 2004amending Directive 2001/113/EC relating to fruit jams, jellies and marmalades and sweetened chestnut purée intended for human consumptionTHE COUNCIL OF THE EUROPEAN UNION,Having regard to the Treaty establishing the European Community, and in particular Article 37 thereof,Having regard to the proposal from the Commission,Having regard to the opinion of the European Parliament,Whereas:(1)Directive 2001/113/ECOJ L 10, 12.1.2002, p. 67. sets out the essential requirements to be met by a number of products defined in Annex I thereof, including "jam" and "marmalade", so that these products may move freely within the internal market.(2)In the German language version, the product names "Konfitüre" and "Marmelade" are used for "jam" and "marmalade" respectively.(3)In certain local markets in Austria and Germany, such as farmer’s markets or weekly markets, the term "Marmelade" has also traditionally been used for the product name "jam"; in such cases, the term "Marmelade aus Zitrusfrüchten" is used for the term "marmalade" in order to distinguish the two product categories.(4)It is therefore appropriate that Austria and Germany should take into account these traditions when adopting the necessary measures to comply with Directive 2001/113/EC.(5)The present Directive should apply from 12 July 2004 in order to ensure the full benefit of its provisions,HAS ADOPTED THIS DIRECTIVE:
