Commission Regulation (EC) No 2245/2002of 21 October 2002implementing Council Regulation (EC) No 6/2002 on Community designsTHE COMMISSION OF THE EUROPEAN COMMUNITIES,Having regard to the Treaty establishing the European Community,Having regard to Council Regulation (EC) No 6/2002 of 12 December 2001 on Community designsOJ L 3, 5.1.2002, p. 1., and in particular Article 107(3) thereof,Whereas:(1)Regulation (EC) No 6/2002 creates a system enabling a design having effect throughout the Community to be obtained on the basis of an application to the Office for Harmonisation in the Internal Market (trade marks and designs) (hereinafter "the Office").(2)For this purpose, Regulation (EC) No 6/2002 contains the necessary provisions for a procedure leading to the registration of a Community design, as well as for the administration of registered Community designs, for appeals against decisions of the Office and for proceedings for the invalidation of a Community design.(3)The present Regulation lays down the necessary measures for implementing the provisions of Regulation (EC) No 6/2002.(4)This Regulation should ensure the smooth and efficient operation of design proceedings before the Office.(5)The measures provided for in this Regulation are in accordance with the opinion of the Committee established under Article 109 of Regulation (EC) No 6/2002,HAS ADOPTED THIS REGULATION:
