COMMISSION REGULATION (EC) No 1968/96 of 14 October 1996 fixing the yields in olives and olive oils for the 1995/96 marketing year

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation 136/66/EEC of 22 September 1996 on the establishment of a common organization of the market in oils and fats (1), as last amended by Regulation (EC) No 1581/96 (2),

Having regard to Council Regulation (EEC) No 2261/84 of 17 1984 laying down general rules on the granting of aid for the production of olive oil and of aid to olive oil producer organizations (3), as last amended by Regulation (EC) No 636/95 (4), and in particular Article 19 thereof,

Whereas Article 18 of Regulation (EEC) No 2261/84 provides that olive yields and oil yields shall be fixed by homogeneous production zones on the basis of the figures supplied by the producer Member States; whereas, in view of the information received, it is appropriate to fix yields as specified in Annex I hereto;

Whereas the demarcation of production zones is as specified in Annex II to Commission Regulation (EEC) No 1934/93 of 8 July 1993 fixing for the 1992/93 marketing year the yields of olives and olive oil (5), as amended by Regulation (EC) No 38/94 (6); whereas, for the 1994/95 marketing year, reference should be made to that Annex for the demarcation of production zones; whereas, however, for administrative and structural reasons, it is necessary to make certain amendments to the homogeneous zones, particularly in Italy, Spain and Greece;

Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Oils and Fats,

HAS ADOPTED THIS REGULATION:

Article 1

1. For the 1995/96 marketing year, yields of olives and olive oil and the relevant production zones shall be as specified in Annex I.

2. The demarcation of the production zones shall be as specified in Annex II to Regulation (EEC) No 1934/93, with the following amendments:

1. Annex II A is amended as follows:

(a) In the province of Firenze, the municipalities of Montemurlo, Prato and Poggio a Caiano are deleted in zone 2 and the municipality of Carmignano is deleted in zone 3.

(b) A new province, Prato, is added after Firenze. This new province is made up of the following zones and municipalities:

2. Montemurlo, Poggio a Caiano, Prato;

3. Carmignano.

(c) The homogeneous zones of the province of Catanzaro are demarcated as follows:

1. Curinga, Feroleto Antico, Gizzeria, Maida, San Pietro a Maida, Lamezia Terme;

2. (*);

3. Andali, Belcastro, Botricello, Catanzaro, Cropani, Sellia Marina, Simeri Crichi, Soveria Simeri, Zagarise;

4. Amato, Caraffa di Catanzaro, Cortale, Davoli, Cagliato, Girifalco, Isca sullo Ionio, Jacurso, Marcellinara, Miglierina, San Pietro Apostolo, San Sostene, Santa Catarina dello Ionio, San Vito sullo Ionio, Sellia, Serrastretta, Sersale, Soverato;

5. Albi, Augusto, Cardinale, Carlopoli, Cenadi, Centrache, Chiaravalle Centrale, Cicala, Conflenti, Decollatura, Fossato Serralta, Gimigliano, Magisano, Martirano, Martirano Lombardo, Motta Santa Lucia, Olivadi, Pentone, Platania, Sorbo San Basile, Soveria Mannelli, Taverna, Torre di Ruggiero.

(d) A new province, Crotone, is added after Catanzaro. This new province comprises the following zones and municipalities:

1. Crotone, Cutro, Isola di Capo Rizzuto, Rocca di Neto;

2. (*);

3. Caccuri Castelsilano, Cerenzia, Cotronei, Mesoraca, Petilia Policastro, Savelli, Verzino.

(e) A new province, Vibo Valentia, is added after Crotone. This new province comprises the following zones and municipalities:

1. Brognaturo, Fabrizia, Filadelfia, Francavilla, Angitola, Mongiana, Nardodipace, Pizzo, Polia, Serra San Bruno, Simbario, Spadola;

2. Acquaro, Arena, Capistrano, Dasà, Dinami, Gerocarne, Monterosso Calabro, Pizzoni, San Nicola da Crissa, Sorianello, Soriano Calabro, Vallelonga, Vazzano;

3. (*);

4. Briatico, Cessaniti, Drapia, Jappolo, Limbadi, Nicotera, Parghelia, Ricadi, San Calogero, Spilinga, Tropea, Zambrone.

2. Annex II C is amended as follows:

(a) The municipality of 'Statheika` is replaced by 'Vrousti` in the prefecture of Argolida, in zone 2.

(b) The prefecture of Attiki is replaced by the following three prefectures:

- the prefecture of Athens

Zone 1:

Towns: Amarousion, Kifisia, Melissia, Papagos, Khalandri;

Municipalities: Nea Pendeli,

- the prefecture of Eastern Attica

Zone 1:

Towns: Ayios, Stefanos, Artemida, Avlona, Akharnes, Vari, Voula, Vouliagmeni, Yerakas, Glika Nera, Kalivia Thorikou, Keratea, Kropia, Lavreotiki, Marathon, Markopoulo, Messoyea, Nea Makri, Peania, Pallini, Rafina, Spata:

Municipalities: Ayios Konstantinos, Anavissos, Anthousa, Anixi, Afidnes, Varnava, Grammatiko, Dionisos, Drosia, Thrakomakedones, Kalamos, Kapandriti, Kouvaras, Krioneri, Malakasa, Markomoulo Oropou, Nea Palatia, Palea Fokea, Pikermi, Polidendri, Rodopoli, Saronida, Skala Oropou, Stamata, Sikamino, Oropos;

- the prefecture of Western Attica

Zone 1:

Towns: Megare, Nea Peramos;

Zone 2:

Town: Villia;

Zone 3:

Towns: Erithres, Elefsina, Mandra, Aspropirgos, Fili, Ano Liosia;

Municipalities: Magoula, Inoi.

(c) The municipalities of Edipsos and Ilia are deleted from zone 11 in the prefecture of Evvia.

(d) In the prefecture of Larisa, the municipalities of Agnanderi and Kefalovriso are added to zone 4.

(e) In the prefecture of Messinia, zones 10, 11 and 12 are subdivided as follows:

Zone 10

Towns and municipalities: Gargaliani, Kiparisia, Filiatra, Agaliani, Armenia, Valta, Vrises, Elea, Exokhiko, Kalo Nero, Karies, Lefki, Marathoupoli, Mouriatada, Mirou, Xirokambos, Perdikoneri, Plati, Rakhes, Spilia, Stasio, Faraklada, Khalazoni;

Zone 11

Towns and municipalities: Khora, Ambelofito, Mouzaki, Pirgos, Floka, Khristiani;

Zone 12

Towns and municipalities: Agrilia, Aetos, Ano Dorio, Artiki, Avlona, Vanada, Vasiliko, Glikorrizi, Dorio, Kalitsena, Kamari, Kefalovrisi, Kokla, Kopanaki, Krioneri, Malthi, Monastiri, Platania, Politea, Prodromos, Sidirokasko, Sitokhori, Khalkia, Khrisokhori, Psari;

Zone 13

Towns and municipalities: Kaloyeresi, Landzounato, Likoudesi, Mali, Metaxada, Paleo Loutro, Raptoulo, Rodia, Sella, Tripila, Flessadia;

Zone 14

Towns and municipalities: Ayios Sostis, Ambeliona, Kakaletri, Kouvela, Neda, Petra, Skliros, Stasimo, Sirrizo.

(f) In the prefecture of Piraeus, zone 7 comprises the following towns and municipalities:

Towns: Salamine, Ayios Ioannis Rendis, Koridallos.

Municipalities: Eandio, Ambelakia, Selina.

(g) In the prefecture of Pella the municipalities of Athira, Agrosikia, N. Milotopos, Paleos Milotopos, Drosero, Anidro, Arkhondiko, Mesiano, Damiano, Leptokariya and Rakhonas are added to zone 2.

(h) In the prefecture of Pieria, the municipality of Paleos Eleftherokhori is deleted from zone 2 and added to zone 1.

(i) In the prefecture of Samos, a new zone 11 is added. The town of Pithagorio and the municipalities of Mitilinio and Khora are added to this zone and deleted from zone 7.

3. Annex II D is amended as follows:

(a) In the Autonomous Community of Aragon:

- in the province of Zaragoza, the municipality of Tauste is added to zone 1, the municipality of Villalba de Perejil is added to zone 2, the municipality of Leciñena is deleted in zone 3 and the municipality of Monegrillo is added to that same zone; the municipalities of Torrellas and Mallen are added to zone 4 and the municipalities of Cosuenda, Alpartir, Alfamen and Plasencia de Jalón are added to zone 5,

- in the province of Teruel, the municipalities of Jatiel, La Portellada and Torre del Compte are added to zone 4,

- in the province of Huesca the municipality of Albero Alto is added to zone 2 and the municipalities of Agüero, Alberuela de Tubo, Altorricón, Baldellou, Ballobar, Castejón del Puente, Estada, Lanaja, Valfarte and Loarre are added to zone 5.

(b) In the Autonomous Community of Castile-La-Mancha:

- In the province of Toledo, the municipality of Ventas de Retamosa is added to zone 2, the municipality of San Martín de los Montes is replaced in zone 5 by San Martín dew Montalban and the municipality of Camunñas is deleted from zone 7.

(c) In the Autonomous Community of Navarra:

- the commune of Buñuel is added to zone 1.

Article 2

This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
