amending the Annex to Regulation (EEC) N° 3846/87 establishing an agricultural product nomenclature for export refunds

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation (EEC) N° 804/68 of 27 June 1968 on the common organization of the market in milk and milk products (1), as last amended by Regulation (EEC) N° 1630/92 (2), and in particular Article 17 thereof,

Having regard to Commission Regulation (EEC) N° 3846/87 of 17 December 1987 establishing an agricultural product nomenclature for export refunds (3), as last amended by Regulation (EEC) N° 3655/91 (4), and in particular Article 3, last subparagraph, thereof,

Whereas pursuant to Council Regulation (EEC) N° 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (5) as last amended by Commission Regulation (EEC) N° 3537/91 (6) all fresh cheeses are grouped under CN code 0406 10 with effect from 1 January 1992;

Whereas Commission Regulation (EEC) N° 3846/87 establishes an agricultural product nomenclature for export refunds on the basis of the tariff nomenclature; whereas sector 10 thereof concerning milk and milk products should be adjusted to take account of the abovementioned amendments;

Whereas this Regulation specifies that as a rule no export refund is granted on cheeses of a free-at-frontier value less than ECU 140 per 100 kilograms; whereas trends in market prices require that this value be updated;

Whereas Regulation (EEC) N° 3846/87 provides for the publication of the full version of the refund nomenclature to be used from 1 January each year as it follows from the regulatory provisions on export arrangements for agricultural products (1),

Whereas account must be taken of amendments to the combined nomenclature introduced by Commission Regulation (EEC) N° 2587/91 of 26 July 1991 amending Annex I to Council Regulation (EEC) N° 2658/87 on the tariff and statistical nomenclature and on the Common Customs Tariff (2) applicable from 1 January 1992;

Whereas the measures provided for in this Regulation concerning the amendments to sector 10 of the Annex are in accordance with the opinion of the Management Committee for Milk and Milk Products,

HAS ADOPTED THIS REGULATION:

Article 1

The Annex to Regulation (EEC) N° 3846/87 is hereby replaced by the Annex hereto.

Article 2

This Regulation shall enter into force on 1 January 1992.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
