amending Regulation (EEC) No 205/73 on communication between Member States and the Commission concerning oils and fats
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Economic Community,
Having regard to Council Regulation No 136/66/EEC of 22 September 1966 on the establishment of a common organization of the market in oils and fats (1), as last amended by Regulation (EEC) No 1454/86 (2), and in particular Article 12 (4) thereof,
Whereas Commission Regulation (EEC) No 205/73 (3), as last amended by Regulation (EEC) No 3916/86 (4), lays down inter alia that the Member States are to supply the Commission with information concerning the olive oil intervention measures provided for in Regulation No 136/66/EEC; whereas, in the light of experience and in order to improve the management of Community stocks, more detailed information must be made available to the Commission and, therefore, Member States' obligations concerning information to be supplied periodically to the Commission should be further specified;
Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for oils and Fats,
HAS ADOPTED THIS REGULATION:
Article 1
Regulation (EEC) No 205/73 is hereby amended as follows:
1. Article 2 is replaced by the following:
'Article 2
With regard to the intervention measures referred to in Article 12 of Regulation No 136/66/EEC, producer Member States shall, before the 10th day of each month, provide the Commission with the information listed in the Annex to this Regulation for the previous month, for each intervention centre.'
2. The present Annex is inserted in the abovementioned Regulation.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Communities.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Explanatory notes:

(2) The layout is as follows:
Offer (A), Delivery (B), Acceptance (C 1), Refusal (C 2), Other (C 3): (quantities other than those which were purchased or refused).
The qualitiy referred to in A or B is that stated by the person offering the product and is without prejudice to the definitive quality as determined by the intervention agency in accordance with the relevant Community rules.
(3) In the case of transfers between intervention centres, the quantity transferred is preceded by a minus sign for the intervntion centre from which it was sent and a plus sign for that to which it was sent.
(4) Downgraded quantities are preceded by a minus sign in the 'quality of origin' column, and broken down by quality recorded into quantities preceded by a plus sign.
Do not cancel out (pluses against minuses).
(5) As tranfers are listed under F, only sales (H), losses, or accounting adjustemts (I) are to be entered here.
(6) The complete emptying of a vat is the occasion for a clearance of accounts; emptying for saleable quality gives an accounting and physical residue and thus a downgrading to be shown under G.
(7) Unusually large missing amounts.
(8) The total includes releases, losses and adjustements (H + I).
(9) K = So + E - J ± G.
The stock So = stock at end of previous marketing year and is to be stated under K and Ka, by locality at the beginning of each marketing year.
(10) Sales in progress: one line for each sales regulation.
(11) Reasons to be specified.
