COMMISSION REGULATION (EEC) No 2573/86

of 12 August 1986

amending Regulations (EEC) No 1871/86 and (EEC) No 2096/86 with regard to documents covering intra-Community movement of cereals exempted from the co-responsibility levy

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation (EEC) No 2727/75 of 29 October 1975 on the common organization of the market in cereals (1), as last amended by Regulation (EEC) No 1579/86 (2), and in particular Article 4 thereof,

Whereas the competent authorities of the Member State are required to issue certificates of entitlement to exemption from the co-responsibility levy for quantities of cereals declared under Commission Regulation (EEC) No 1871/86 (3), as amended by Regulation (EEC) No 2366/86 (4), and also for cereals grown by small producers entitled to exemption under Commission Regulation (EEC) No 2096/86 (5);

Whereas it is necessary to introduce procedures covering the movement of exempted cereals between Member States;

Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Cereals,

HAS ADOPTED THIS REGULATION:

Article 1

The following subparagraph is hereby added to Article 5 (2) of Regulation (EEC) No 1871/86.

'When cereals exempted from the levy are consigned to another Member State the document certifying that they are Community cereals shall carry one of the following endorsements stamped by the customs office of departure:

- Cereales almacenados a finales de la campaña de comercialización 1985/86 - exoneración de la tasa de corresponsabilidad en virtud del artículo 5 del Reglamento (CEE) no 1871/86

- Korn, som er oplagret ved slutningen af hestaaret 1985/86 - fritagelse for medansvarsafgiften i henhold til artikel 5 i forordning (EOEF) nr. 1871/86

- Am Ende des Wirtschaftsjahres 1985/86 gelagertes Getreide - Befreiung von der Mitverantwortungsabgabe gemaess Artikel 5 der Verordnung (EWG) Nr. 1871/86

- Sitirá poy vrískontan se apóthema sto télos tis periódoy emporías 1985/86 - apallagí apó tin eisforá synypefthynótitas dynámei toy árthroy 5 toy kanonismoý (EOK) arith. 1871/86

- Cereals in storage at the end of the 1985/86 marketing year - exemption from co-responsibility levy under Article 5 of Regulation (EEC) No 1871/86

- Céréales en stock à la fin de la campagne de commercialisation 1985/1986 - exonération du prélèvement de coresponsabilité en vertu de l'article 5 du règlement (CEE) no 1871/86

- Cereali immagazzinati alla fine della campagna di commercializzazione 1985/1986 - esenzione dal prelievo di corresponsabilità in virtù dell'articolo 5 del regolamento (CEE) n. 1871/86

- Graan in voorraad aan het einde van het verkoopseizoen 1985/1986 - vrijstelling van de medeverantwoordelijkheidsheffing op grond van artikel 5 van Verordening (EEG) nr. 1871/86

- Cereais em armazém no final da campanha de comercialização de 1985/1986 - isenção da taxa de co-responsabilidade, por força do artigo 5º do Regulamento (CEE) nº 1871/86. »

Article 2

Regulation (EEC) No 2096/86 is amended as follows,

1. In Article 4 (2) the words 'and to the other Member States' are deleted.

2. The following subparagraph is added to Article 4 (2).

'When cereals exempted from the levy are consigned to another Member State the document certifying that they are Community cereals shall carry one of the following endorsements stamped by the customs office of departure:

- Régimen de ayuda directa en favor de los pequeños productores de cereales - exoneración de la tasa de corresponsabilidad en virtud del artículo 4 del Reglamento (CEE) no 2096/86

- Stoetteordningen for mindre kornproducenter - fritagelse for medansvarsafgiften i henhold til artikel 4 i forordning (EOEF) nr. 2096/86

- Regelung der direkten Beihilfe fuer Kleinerzeuger von Getreide - Befreiung von der Mitverantwortungsabgabe gemaess Artikel 4 der Verordnung (EWG) Nr. 2096/86

- Kathestós ámesis eníschysis ypér ton mikrón paragogón sitirón - apallagí apó tin eisforá synypefthynótitas dynámei toy árthroy 4 toy kanonismoý (EOK) arith. 2096/86

- Direct aid scheme for small producers of cereals - exemption from co-responsibility levy under Article 4 of Regulation (EEC) No 2096/86

- Régime d'aide directe en faveur des petits producteurs de céréales - exonération du prélèvement de coresponsabilité en vertu de l'article 4 du règlement (CEE) no 2096/86

- Regime di aiuto diretto a favore dei piccoli produttori di cereali - esenzione dal prelievo di corresponsabilità in virtù dell'articolo 4 del regolamento (CEE) n. 2096/86

- Rechtstreekse steun voor de kleine producenten in de graansector - vrijstelling van de medeverantwoordelijkheidsheffing op grond van artikel 4 van Verordening (EEG) nr. 2096/86

- Regime de ajuda directa em favor dos pequenos produtores de cereais - isenção da taxa de co-responsabilidade, por força do artigo 4º do Regulamento (CEE) nº 2096/86. »

Article 3

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
