fixing the accession compensatory amounts for olive oil for 1985/86

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to the Act of Accession of Spain and Portugal,

Having regard to Council Regulation (EEC) No 473/86 of 25 February 1986 laying down the general rules for the system of accession compensatory amounts for olive oil (1), and in particular Article 7 (3) thereof,

Whereas Council Regulation (EEC) No 453/86 (2) fixed, for 1985/86, the intervention prices for olive oil applicable in Spain and Portugal;

Whereas the detailed rules for the application of accession compensatory amounts are laid down in Commission Regulation (EEC) No 583/86 laying down the detailed rules for the application of accession compensatory amounts for olive oil (3);

Whereas Commission Regulation (EEC) No 584/86 of 28 February 1986 laying down transitional arrangements relating to the detailed rules for the buying in of olive oil by intervention agencies in Spain and Portugal (4) fixed, for olive-residue oil produced in Spain, price reductions differing from those fixed for the other Member States;

Whereas Articles 72 (1) and 240 (1) of the Act of Accession provide for the incidence of some national aids to be taken into account; whereas Council Regulation (EEC) No 3774/85 of 20 December 1985 concerning certain national aids in the agricultural sector which are incompatible with the common market but which the Portuguese Republic is authorized to maintain on a transitional basis (5) provdes for the continuation of aid for the consumption of olive oil in Portugal; wheeas the aid should be taken into consideration when accession compensatory amounts are granted or levied in the previous conditions of Article 5 in Regulation (EEC) No 583/86;

Whereas Commission Regulation (EEC) No 583/86 fixed the arrangements relating to the accession compensatory amounts for olive oil;

Whereas the application of the rules laid down in Regulation (EEC) No 3774/85 results in compensatory amounts being fixed as set out below,

HAS ADOPTED THIS REGULATION:

Article 1

The accession compensatory amounts applicable in 1985/86 for olive oil shall be as shown in the Annex.

Article 2

This Regulation shall enter into force on 1 March 1986.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
