amending for the second time Regulation (EEC) No 3039/79 laying down conditions for the entry of natural sodium nitrate and natural potassic sodium nitrate falling within subheadings 31.02 A and 31.05 A III a) respectively of the Common Customs Tariff

THE COMMISSION OF THE EUROPEAN

COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation (EEC) No 97/69 of 16 January 1969 on measures to be taken for uniform application of the nomenclature of the Common Customs Tariff (1), as last amended by the Act of Accession of Greece, and in particular Articles 3 and 4 thereof,

Whereas the 'Laboratorio del Servicio de Minas del Estado, Antofagasta' which is notified in Annex II to Regulation (EEC) No 3039/79 (2) as the issuing authority for certificates of quality for natural sodium nitrate and natural potassic sodium nitrate exported from the Republic of Chile to the Community, has been replaced by the 'Servicio Nacional de Geología y Minería' established at Santiago;

Whereas certain errors in the Spanish text of the certificate have been reproduced in Annex I to the aforesaid Regulation, and in particular in boxes 9, 10, 12 and 13;

Whereas it is therefore necessary to make appropriate amendments to Annexes I and II to Commission Regulation (EEC) No 3039/79;

Whereas the measures provided for in this Regulation are in accordance with the opinion of the Committee on Common Customs Tariff nomenclature,

HAS ADOPTED THIS REGULATION:

Article 1

Annexes I and II to Regulation (EEC) No 3039/79 are hereby replaced by Annexes I and II to this Regulation.

Article 2

This Regulation shall enter into force on the day following its publication in the Official Journal of the European Communities.

However, up to 28 February 1982, certificates issued by Laboratorio del Servicio de Minas de Estado, Antofagasta may be used.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
