OF 12 JANUARY 1979
SUBJECTING TO AUTHORIZATION THE IMPORTATION INTO ITALY OF ELECTRIC FILAMENT LAMPS ORIGINATING IN CERTAIN EUROPEAN STATE-TRADING COUNTRIES
THE COMMISSION OF THE EUROPEAN COMMUNITIES ,
HAVING REGARD TO THE TREATY ESTABLISHING THE EUROPEAN ECONOMIC COMMUNITY ,
HAVING REGARD TO COUNCIL REGULATION ( EEC ) NO 109/70 OF 19 DECEMBER 1969 ESTABLISHING COMMON RULES FOR IMPORTS FROM STATE-TRADING COUNTRIES ( 1 ) , AND IN PARTICULAR ARTICLE 7 THEREOF ,
HAVING CONSULTED THE ADVISORY COMMITTEE SET UP UNDER ARTICLE 5 OF THE SAID REGULATION ,
WHEREAS BY REGULATION ( EEC ) NO 1887/76 OF 29 JULY 1976 ( 2 ) THE COMMISSION ESTABLISHED RULES WHEREBY IMPORTS INTO ITALY OF ELECTRIC FILAMENT LAMPS ORIGINATING IN CERTAIN EUROPEAN STATE-TRADING COUNTRIES WERE MADE SUBJECT TO AUTHORIZATION ;
WHEREAS BY REGULATIONS ( EEC ) NO 2162/76 ( 3 ) , ( EEC ) NO 3205/76 ( 4 ) AND ( EEC ) NO 2898/77 ( 5 ) AS AMENDED BY REGULATION ( EEC ) NO 2372/78 ( 6 ) , THE COUNCIL MAINTAINED THESE RULES IN EFFECT UNTIL 31 DECEMBER 1978 ;
WHEREAS THE ECONOMIC DIFFICULTIES WHICH JUSTIFIED THE INTRODUCTION OF THESE PROTECTIVE MEASURES PERSIST ON THE ITALIAN MARKET ;
WHEREAS IN PARTICULAR ELECTRIC FILAMENT LAMPS ORIGINATING IN CERTAIN STATE-TRADING COUNTRIES CONTINUE TO BE IMPORTED INTO ITALY AT PRICES WELL BELOW THE PRICE OF SIMILAR ITALIAN PRODUCTS ; WHEREAS THERE WOULD BE A SERIOUS INJURY OR THREAT THEREOF TO THE PRODUCERS IN THIS REGION OF THE COMMUNITY IF PROTECTIVE MEASURES WERE NOT REINTRODUCED ;
WHEREAS THESE MEASURES SHOULD CONSEQUENTLY BE REINTRODUCED UNTIL 31 DECEMBER 1979 FOR THE ITALIAN MARKET IN RESPECT OF THE GERMAN DEMOCRATIC REPUBLIC , CZECHOSLOVAKIA AND THE USSR ;
WHEREAS THE MEASURES CAN BE REVOKED IN THE EVENT THAT THOSE COUNTRIES ENTER INTO CONSULTATIONS WITH THE COMMUNITY AND THESE CONSULTATIONS RESULT IN MUTUALLY SATISFACTORY SOLUTIONS ,
HAS ADOPTED THIS REGULATION :
ARTICLE 1
THE IMPORTATION INTO ITALY OF ELECTRIC FILAMENT LAMPS ( NIMEXE CODE 85.20-15 ) ORIGINATING IN THE GERMAN DEMOCRATIC REPUBLIC , CZECHOSLOVAKIA AND THE SOVIET UNION SHALL BE SUBJECT TO AN IMPORT AUTHORIZATION DELIVERED BY THE COMPETENT ITALIAN AUTHORITIES ;
THE TOTAL QUANTITY OF PRODUCTS FOR WHICH IMPORT AUTHORIZATIONS MAY BE ISSUED WITH EFFECT FROM THE ENTRY INTO FORCE OF THIS REGULATION DURING THE YEAR 1979 SHALL NOT EXCEED THE FOLLOWING AMOUNTS :

ARTICLE 2
THIS REGULATION SHALL ENTER INTO FORCE ON THE DAY FOLLOWING ITS PUBLICATION IN THE OFFICIAL JOURNAL OF THE EUROPEAN COMMUNITIES .
IT SHALL APPLY UNTIL THE ENTRY INTO FORCE OF APPROPRIATE MEASURES TO BE TAKEN BY THE COUNCIL IN ACCORDANCE WITH ARTICLES 7 ( 6 ) AND 8 OF REGULATION ( EEC ) NO 109/70 AND AT THE LATEST UNTIL THE EXPIRY OF A PERIOD OF SIX WEEKS FROM ITS ENTRY INTO FORCE .
THIS REGULATION SHALL BE BINDING IN ITS ENTIRETY AND DIRECTLY APPLICABLE IN ALL MEMBER STATES .
