AMENDING FOR THE SECOND TIME REGULATION ( EEC ) NO 2015/76 ON STORAGE CONTRACTS FOR TABLE WINE , GRAPE MUST AND CONCENTRATED GRAPE MUST

HAVING REGARD TO THE TREATY ESTABLISHING THE EUROPEAN ECONOMIC COMMUNITY ,

HAVING REGARD TO COUNCIL REGULATION ( EEC ) NO 816/70 OF 28 APRIL 1970 LAYING DOWN ADDITIONAL PROVISIONS FOR THE COMMON ORGANIZATION OF THE MARKET IN WINE ( 1 ), AS LAST AMENDED BY REGULATION ( EEC ) NO 1861/78 ( 2 ), AND IN PARTICULAR THE SECOND SUBPARAGRAPH OF ARTICLE 5 ( 7 ), ARTICLE 5A ( 3 ), ARTICLE 6 ( 5 ) AND ARTICLE 6C ( 4 ) THEREOF ,

WHEREAS COMMISSION REGULATION ( EEC ) NO 2015/76 ( 3 ), AS AMENDED BY REGULATION ( EEC ) NO 2206/77 ( 4 ), LAYS DOWN RULES GOVERNING STORAGE CONTRACTS FOR TABLE WINE , GRAPE MUST AND CONCENTRATED GRAPE MUST ;

WHEREAS EXPERIENCE HAS SHOWN THAT THE MINIMUM QUANTITY , FOR WHICH CONTRACTS MAY BE CONCLUDED FOR CONCENTRATED MUST , SPECIFIED IN ARTICLE 5 OF REGULATION ( EEC ) NO 2015/76 IS IN CERTAIN CASES TOO LARGE ; WHEREAS IN ORDER TO ENCOURAGE THE STORAGE OF GREATER QUANTITIES OF CONCENTRATED MUST THE SIZE OF THIS MINIMUM QUANTITY SHOULD BE REDUCED ;

WHEREAS THE AID AMOUNTS SPECIFIED IN ARTICLE 11 OF REGULATION ( EEC ) NO 2015/76 NO LONGER COVER TECHNICAL STORAGE AND INTEREST COSTS ; WHEREAS THEY SHOULD BE ADJUSTED IN LINE WITH THE RISE IN COSTS ;

WHEREAS THE MEASURES PROVIDED FOR IN THIS REGULATION ARE IN ACCORDANCE WITH THE OPINION OF THE MANAGEMENT COMMITTEE FOR WINE ,

HAS ADOPTED THIS REGULATION :

ARTICLE 1

REGULATION ( EEC ) NO 2015/76 IS HEREBY AMENDED AS FOLLOWS :

1 . ARTICLE 5 SHALL READ AS FOLLOWS :

' ARTICLE 5

CONTRACTS SHALL COVER A MINIMUM QUANTITY OF 100 HECTOLITRES IN THE CASE OF WINE , 50 HECTOLITRES IN THE CASE OF MUST AND 30 HECTOLITRES IN THE CASE OF CONCENTRATED MUST . '

2 . ARTICLE 11 SHALL READ AS FOLLOWS :

' ARTICLE 11

THE FOLLOWING STORAGE RATES PER DAY PER HECTOLITRE SHALL APPLY THROUGHOUT THE COMMUNITY :

( A ) FOR TABLE WINES OF TYPES R I , R II , R III AND A I AND TABLE WINES IN CLOSE ECONOMIC RELATION TO THEM : 0.0079 U.A .;

( B ) FOR TABLE WINES OF TYPES A II AND A III AND TABLE WINES IN CLOSE ECONOMIC RELATION WITH THEM : 0.0117 U.A .;

( C ) FOR MUSTS OF A DENSITY OF LESS THAN 1.24 AT 20 * C :

- PRODUCED FROM GRAPES OTHER THAN SYLVANER , MUELLER THURGAU OR RIESLING VARIETIES : 0.0095 U.A .,

- PRODUCED FROM GRAPES OF THE SYLVANER , MUELLER THURGAU OR RIESLING VARIETIES : 0.0140 U.A .;

( D ) FOR CONCENTRATED GRAPE MUSTS OF A DENSITY OF 1.24 OR MORE AT 20 * C :

- OBTAINED BY CONCENTRATION OF THE MUSTS REFERRED TO IN THE FIRST INDENT UNDER ( C ): 0.0317 U.A .,

- OBTAINED BY CONCENTRATION OF THE MUSTS REFERRED TO IN THE SECOND INDENT UNDER ( C ): 0.0350 U.A . '

ARTICLE 2

THIS REGULATION SHALL ENTER INTO FORCE ON THE DAY FOLLOWING ITS PUBLICATION IN THE OFFICIAL JOURNAL OF THE EUROPEAN COMMUNITIES .

THIS REGULATION SHALL BE BINDING IN ITS ENTIRETY AND DIRECTLY APPLICABLE IN ALL MEMBER STATES .
