on the adjustment of the subsidies granted under Regulation (EEC) No 3062/74

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation (EEC) No 3330/74 of 19 December 1974 on the common organization of the market in sugar [1], as last amended by Regulation (EEC) No 832/76 [2], and in particular Articles 17 (5) and 19 (4) thereof,

Whereas under Article 16 (2) and (3) of Commission Regulation (EEC) No 3062/74 of 3 December 1974 on a standing invitation to tender to determine subsidies for imports of white and raw sugar [3], as last amended by Regulation (EEC) No 363/75 [4], successful tenderers in partial tendering taking place before 8 February 1975 are on application to be paid a supplementary amount equal to the difference between the target price applying on the day on which the time limit for the submission of the tenders in response to the partial invitation concerned expired and the target price on the day on which customs export formalities were completed; whereas in the calculation of this difference the target price is increased by the fixed amount of 1,59 units of account specified in the second subparagraph of Article 8 (3) of Regulation (EEC) No 3062/74; whereas the amounts thus obtained are converted at the conversion rate applying for the purposes of the common agricultural policy to the currency of the Member State concerned ;

Whereas the subsidies were first adjusted by Regulation (EEC) No 2865/75 [5]; whereas for exports made on or after 1 July 1976 a further adjustment is required to take into account the target price fixed under Regulation (EEC) No 833/76 [6] for the 1976/77 sugar marketing year ;

Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Sugar,

HAS ADOPTED THIS REGULATION :

Article 1

For quantities of sugar in respect of which customs export formalities are completed on or after 1 July 1976, in connection with partial tendering which took place before 8 February 1975, the difference referred to in Article 16 (2) of Regulation (EEC) No 3062/74 shall be as shown in the Annex hereto.

Article 2

This Regulation shall enter into force on 1 July 1976.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
