concerning an invitation to tender for the supply of butteroil bought on the Community market for the Arab Republic of Egypt as food aid
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Economic Community;
Having regard to Council Regulation (EEC) No 804/68 [1] of 27 June 1968 on the common organization of the market in milk and milk products, as last amended by Regulation (EEC) No 740/75 [2], and in particular Article 6 (7) thereof;
Whereas Council Regulation (EEC) No 1542/75 [3] of 16 June 1975 on the supply of milk fats as food aid to certain developing countries and international organizations under the 1975 food-aid programme, provides inter alia that 1500 metric tons of butteroil should be made available to the Arab Republic of Egypt; whereas this country has made a request for delivery of the abovementioned quantity;
Whereas on account of the market situation for butter in the Community, the supply of the abovementioned quantity should be ensured by means of butterfat available on the Community market in accordance with Article 2 (2) of Council Regulation (EEC) No 1541/75 [4] of 16 June 1975 laying down general rules for the supply of milk fats as food aid to certain developing countries and international organizations under the 1975 food-aid programme; whereas an invitation to tender should therefore be issued in accordance with Commission Regulation (EEC) No 2660/75 [5] of 20 October 1975 on invitations to tender for the supply of butteroil bought on the Community market as food aid to certain developing countries and to the World Food Programme;
Whereas for the application of Regulation (EEC) No 2660/75 certain detailed rules are however required, in particular as regards the time limit for the submission of tenders and the conditions of delivery of the butteroil;
Whereas the measures provided for in this Regulation are in accordance with the Opinion of the Management Committee for Milk and Milk Products,
HAS ADOPTED THIS REGULATION:
Article 1
1. Tenders are invited in accordance with the provisions of Regulation (EEC) No 2660/75 for the supply to the Arab Republic of Egypt of one lot of 1500 metric tons of butteroil manufactured from butterfats which are of Community origin and not taken from public stocks, divided into three lots of 500 metric tons.
2. With regard to quality and packaging the butteroil shall comply with the conditions laid down in the Annex to Regulation (EEC) No 2660/75. However, it shall exclusively be put in 5 kg canisters.
3. The words to be stamped on the packaging as referred to in Chapter II under 2 (b) of the Annex mentioned in the precedent paragraph shall be as follows:
"Butteroil — Gift of the European Economic Community to the Arab Republic of Egypt — For free distribution."
Article 2
1. The port of embarkation indicated in the tender shall be chosen from among the ports in the Community accessible for ocean-going ships and having a regular service to the recipient country.
Each tender shall indicate only one port.
2. Delivery shall be effected on a date to be fixed by the intervention agency concerned which must be after 10 and before 28 February 1976.
Article 3
1. By way of derogation from Article 4 (2) of Regulation (EEC) No 2660/75, the tenderer shall indicate if his tender is valid only for one, two or three lots put out for tender.
2. The time limit for the submission of tenders expires on 6 January 1976 at 12 noon.
Article 4
This Regulation shall enter into force on the day following its publication in the Official Journal of the European Communities.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
