Commission Regulation (EU) 2024/2801of 25 October 2024establishing a fisheries closure for demersal species in ICES area VIII for vessels equal to or more than 15 metres in length flying the flag of Belgium THE EUROPEAN COMMISSION,Having regard to the Treaty on the Functioning of the European Union,Having regard to Council Regulation (EC) No 1224/2009 of 20 November 2009 establishing a Union control system for ensuring compliance with the rules of the common fisheries policy, amending Regulations (EC) No 847/96, (EC) No 2371/2002, (EC) No 811/2004, (EC) No 768/2005, (EC) No 2115/2005, (EC) No 2166/2005, (EC) No 388/2006, (EC) No 509/2007, (EC) No 676/2007, (EC) No 1098/2007, (EC) No 1300/2008, (EC) No 1342/2008 and repealing Regulations (EEC) No 2847/93, (EC) No 1627/94 and (EC) No 1966/2006OJ L 343, 22.12.2009, p. 1., and in particular Article 36(2) thereof,Whereas:(1)Council Regulation (EC) No 1415/2004Council Regulation (EC) No 1415/2004 of 19 July 2004 fixing the maximum annual fishing effort for certain fishing areas and fisheries (OJ L 258, 5.8.2004, p. 1). lays down the maximum levels of annual fishing effort.(2)According to the information received by the Commission, the maximum levels of annual fishing effort fixed for demersal species in ICES area VIII for vessels equal to or more than 15 metres in length flying the flag of Belgium are deemed to have been reached for 2024.(3)It is therefore necessary to prohibit certain fishing activities for that stock group,HAS ADOPTED THIS REGULATION:
Article 1Effort exhaustionThe maximum levels of annual fishing effort allocated to Belgium for the stock group of demersal species in ICES area VIII for 2024 referred to in the Annex shall be deemed to be reached from the date set out in that Annex.
Article 2ProhibitionsFishing activities for the stock referred to in Article 1 by vessels equal to or more than 15 metres in length flying the flag of or registered in Belgium shall be prohibited from the date set out in the Annex. In particular it shall be prohibited to retain on board, relocate, tranship or land fish from that stock caught by those vessels after that date.
Article 3Entry into forceThis Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
