The application was recorded under case number BC-HA032066-67 in the Register for Biocidal Products.(2)"LANXESS CMIT/MIT biocidal product family" contains "mixture of 5-chloro-2-methyl-2H-isothiazol-3-one and 2-methyl-2H-isothiazol-3-one (3:1) (Mixture of CMIT/MIT)" as the active substance, included in the Union list of approved active substances referred to in Article 9(2) of Regulation (EU) No 528/2012 for product-types 6, 11, 12 and 13.(3)On 8 March 2023, the evaluating competent authority submitted, in accordance with Article 44(1) of Regulation (EU) No 528/2012, an assessment report and the conclusions of its evaluation to the Agency.(4)On 2 October 2023, the Agency submitted to the Commission its opinionOpinion of the Biocidal Products Committee of 13 September 2023 on the Union authorisation of "LANXESS CMIT/MIT biocidal product family" (ECHA/BPC/391/2023), https://echa.europa.eu/opinions-on-union-authorisation., the draft summary of the biocidal product characteristics ("SPC") of "LANXESS CMIT/MIT biocidal product family" and the final assessment report on the biocidal product family, in accordance with Article 44(3) of Regulation (EU) No 528/2012.(5)The opinion concludes that "LANXESS CMIT/MIT biocidal product family" is a biocidal product family within the meaning of Article 3(1), point (s), of Regulation (EU) No 528/2012, that it is eligible for Union authorisation in accordance with Article 42(1) of that Regulation and that, subject to compliance with the draft SPC, it meets the conditions laid down in Article 19(1) and (6) of that Regulation.(6)On 23 October 2023, the Agency transmitted to the Commission the draft SPC in all the official languages of the Union in accordance with Article 44(4) of Regulation (EU) No 528/2012.(7)The Commission concurs with the opinion of the Agency and considers it therefore appropriate to grant a Union authorisation for "LANXESS CMIT/MIT biocidal product family".(8)The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Biocidal Products,HAS ADOPTED THIS REGULATION:
Article 1A Union authorisation with authorisation number EU-0031652-0000 is hereby granted to Lanxess Deutschland GmbH for the making available on the market and use of the biocidal product family "LANXESS CMIT/MIT biocidal product family" subject to compliance with the summary of the biocidal product characteristics set out in the Annex.The Union authorisation is valid from 17 November 2024 to 31 October 2034.
Article 2This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

4.13.1.Use-specific instructionsDuring the shutdown of production, it is recommended to counteract microbiological growth inside the membrane elements. Before the shutdown, the plant has to be cleaned first, to remove all sorts of deposits like carbonates, salts, silica, organic matter or biomass. For this purpose, specialized membrane cleaners are used. After cleaning, the plant is flushed with permeate quality water until neutral pH is achieved. Only after these cleaning steps, CMIT/MIT containing water shall reach the plant and shall be regularly circulated by slow pumping. The biocidal product shall be added to the fill-water (permeate quality), to avoid microbiological growth during longer shut downs. During longer shut downs, the fill-water shall be regularly circulated by slow pumping and sampled to check for a microbiological re-contamination. A shift in pH can be a first indication of a re-contamination by microbiology. For more technical information, see the currently valid product information sheet which will be provided to customers upon request.The product labels give instructions on the dosage of the product.General use informationPT 11For use as a biocide for the preservation of cooling fluids in circulating systems from infestation with harmful organisms such as bacteria (including Legionella), fungi, yeasts and algae.Heavily infested units shall be cleaned prior to treatment.The biocidal product is added to the water circuit to be treated at a point at which a rapid and even distribution of the biocide can be ensured.The microbiocidal effect begins immediately after metering.The dose strongly depends on the formulation and intended use of the product to which the preservative is added. Therefore, the user shall determine dosage requirements for their specific matrix/system to be preserved. 4.14.1.Use-specific instructionsDuring the shutdown of production, it is recommended to counteract microbiological growth inside the membrane elements. Before the shutdown, the plant shall be cleaned first, to remove all sorts of deposits like carbonates, salts, silica, organic matter or biomass. For this purpose, specialized membrane cleaners are used. After cleaning, the plant is flushed with permeate quality water until neutral pH is achieved. Only after these cleaning steps, CMIT/MIT containing water is reaching the plant and is regularly circulated by slow pumping. The biocidal product shall be added to the fill-water (permeate quality), to avoid microbiological growth during longer shutdowns. During longer shutdowns, the fill-water shall be regularly circulated by slow pumping and sampled to check for a microbiological re-contamination. 4.14.1.Use-specific instructionsDuring the shutdown of production, it is recommended to counteract microbiological growth inside the membrane elements. Before the shutdown, the plant shall be cleaned first, to remove all sorts of deposits like carbonates, salts, silica, organic matter or biomass. For this purpose, specialized membrane cleaners are used. After cleaning, the plant is flushed with permeate quality water until neutral pH is achieved. Only after these cleaning steps, CMIT/MIT containing water is reaching the plant and is regularly circulated by slow pumping. The biocidal product shall be added to the fill-water (permeate quality), to avoid microbiological growth during longer shut downs. During longer shut downs, the fill-water shall be regularly circulated by slow pumping and sampled to check for a microbiological re-contamination. 4.13.1.Use-specific instructionsDuring the shutdown of production, it is recommended to counteract microbiological growth inside the membrane elements. Before the shutdown, the plant shall be cleaned first, to remove all sorts of deposits like carbonates, salts, silica, organic matter or biomass. For this purpose, specialized membrane cleaners are used. After cleaning, the plant is flushed with permeate quality water until neutral pH is achieved. Only after these cleaning steps, CMIT/MIT containing water is reaching the plant and is regularly circulated by slow pumping. The biocidal product shall be added to the fill-water (permeate quality), to avoid microbiological growth during longer shut downs. During longer shut downs, the fill-water shall be regularly circulated by slow pumping and sampled to check for a microbiological re-contamination. A shift in pH can be a first indication of a re-contamination by microbiology. In this case the fill-up solution shall be replaced.The dose strongly depends on the formulation and intended use of the product to which the preservative is added.
