Commission Implementing Regulation (EU) 2021/2130of 2 December 2021amending Implementing Regulation (EU) 2020/1201 as regards the lists of plants known to be susceptible to Xylella fastidiosa THE EUROPEAN COMMISSION,Having regard to the Treaty on the Functioning of the European Union,Having regard to Regulation (EU) 2016/2031 of the European Parliament and of the Council of 26 October 2016 on protective measures against pests of plants, amending Regulations (EU) No 228/2013, (EU) No 652/2014 and (EU) No 1143/2014 of the European Parliament and of the Council and repealing Council Directives 69/464/EEC, 74/647/EEC, 93/85/EEC, 98/57/EC, 2000/29/EC, 2006/91/EC and 2007/33/ECOJ L 317, 23.11.2016, p. 4., and in particular Article 28(1) and (2) thereof,Whereas:(1)Since the adoption of Commission Implementing Regulation (EU) 2020/1201Commission Implementing Regulation (EU) 2020/1201 of 14 August 2020 as regards measures to prevent the introduction into and the spread within the Union of Xylella fastidiosa (Wells et al.) (OJ L 269, 17.8.2020, p. 2)., the European Food Safety Authority updated its database of host plants susceptible to Xylella fastidiosa (Wells et al.) by including the species Salvia rosmarinus as host of all the Xylella subspecies.(2)That species should therefore be listed under Annex II to that Regulation, as specified plant susceptible to Xylella fastidiosa subspecies pauca, as it is already listed for the subspecies multiplex and fastidiosa.(3)Moreover, the genus Rosmarinus should be removed from Annexes I and II to Regulation (EU) 2020/1201, as its denomination is no longer in use and has been replaced with the denomination Salvia rosmarinus.(4)Implementing Regulation (EU) 2020/1201 should therefore be amended accordingly.(5)The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,HAS ADOPTED THIS REGULATION:
Article 1Amendments to Implementing Regulation (EU) 2020/1201Implementing Regulation (EU) 2020/1201 is amended as follows:(1)Annex I is replaced by the text set out in Annex I to this Regulation;(2)Annex II is replaced by the text set out in Annex II to this Regulation.
Article 2Entry into forceThis Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
