Article 21.With a view to the release for free circulation in the Community pursuant to Article 15(1) of Regulation (EC) No 1706/98 of products falling within CN codes 07141091 and 07149011, Section 8 of licence applications and import licences shall contain the name of the ACP State in which the product originates. Licences shall carry with them an obligation to import from that country.2.Section 24 of additional import licences shall contain one of the entries shown in Annex I.
Article 3Member States shall notify the Commission before the end of each month of the quantities for which import licences for products originating in the ACP States as referred to in Article 1 have been applied for during the preceding four weeks, broken down by Combined Nomenclature code and country of origin.
Article 1This Regulation lays down the detailed rules for importing:products falling within CN codes 07141091 and 07149011 originating in the ACP States and imported into the Community (Title I),products falling within CN codes 07141091 and 07149011 originating in the ACP States and the overseas countries and territories and imported into the French overseas departments (Title II).Commission Regulations (EC) No 1291/2000OJ L 152, 24.6.2000, p. 1., (EC) No 1342/2003OJ L 189, 29.7.2003, p. 12. and EC (No) 1301/2006OJ L 238, 1.9.2006, p. 13. shall apply, save as otherwise provided for in this Regulation.
TITLE II
Article 4The following special provisions shall apply to the release for free circulation in the French overseas departments pursuant to Article 3(4) of Regulation (EC) No 2286/2002 of products falling within CN codes 07141091 and 07149011:(a)monitoring of these imports shall be carried out under the same conditions as those applicable to the import quotas, under serial number 09.4192;(b)licence applications shall be for a quantity not exceeding 500 tonnes per applicant;(c)section 8 of licence applications and import licences shall contain the name of the ACP State or the overseas country or territory in which the product originates. Licences shall entail an obligation to import from that country or territory;(d)section 24 of additional import licences shall contain one of the entries shown in Annex II.
Article 51.Licence applications shall be lodged with the competent authorities of the Member States every Monday before 1 p.m. (Brussels time) or, if that day is not a working day, on the first working day following.2.No later than 13.00 (Brussels time) on the working day following the day on which the licence application is lodged, Member States shall send the Commission the total quantities covered by licence applications, by origin and product code.3.Not later than the fourth working day following the day on which the applications are lodged, the Commission shall determine and inform the Member States by telex or fax to what extent the licence applications are accepted.4.Import licences shall be issued on the fourth working day following the notification referred to in Article 5(2).5.Licences shall be valid exclusively for release for free circulation in the French overseas departments from their actual day of issue pursuant to Article 23(2) of Regulation (EC) No 1291/2000 to the end of the second month following, but only up to the end of the year of issue.
Article 6Notwithstanding Article 8(4) of Regulation (EEC) No 3719/88, the quantity released for free circulation may not exceed that set out in Sections 17 and 18 of the import licence. The figure 0 shall be entered for this purpose in Section 19 of the licence.
TITLE IIIGeneral provisions
Article 71.Notwithstanding Article 10 of Regulation (EC) No 1162/95, the amount of the security in respect of the import licence shall be ECU 0,5 per tonne.2.In cases where, as a result of the application of Article 5(3), the quantity for which the licence is issued is less than that for which it was applied for, the amount of the security corresponding to the difference shall be released.3.The fourth indent of Article 5(1) of Regulation (EEC) No 3719/88 shall not apply.
Article 8Regulation (EEC) No 2245/90 is hereby repealed.
Article 9This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities.
