Commission Regulation (EC) No 2211/94of 12 September 1994laying down detailed rules for the implementation of Council Regulation (EEC) No 3759/92 as regards the notification of the prices of imported fishery products THE COMMISSION OF THE EUROPEAN COMMUNITIES,Having regard to the Treaty establishing the European Community,Having regard to Council Regulation (EEC) 3759/92 of 17 December 1992 on the common organization of the market in fishery and aquaculture productsOJ No L 388, 31. 12. 1992, p. 1., as last amended by Regulation (EEC) No 1891/93OJ No L 172, 15. 7. 1993, p. 1., and in particular Articles 22 (6) and 23 (5) thereof,Whereas Article 22 (3) of Regulation (EEC) No 3759/92 requires Member States to notify to the Commission the prices of certain imported fish and fish products; whereas the exact price to be notified should be defined; whereas the frequency and form of such notifications should be specified; whereas it should be settled which are the markets or ports where the volumes of trade are such that they are representative of the terms of trade in general and where these prices should therefore be recorded;Whereas this present Regulation should replace Commission Regulation (EEC) 3191/82 of 29 November 1982 laying down detailed rules for the application of the reference price system for fishery productsOJ No L 338, 30. 11. 1982, p. 13., as amended by Regulation (EEC) No 3474/85OJ No L 333, 11. 12. 1985, p. 16.;Whereas Article 4 of Commission Regulation (EEC) No 1985/74 of 25 July 1974 laying down detailed rules of application for the fixing of reference prices and free-at-frontier prices for carpOJ No L 207, 29. 7. 1974, p. 30., as amended by Regulation (EEC) No 2046/85OJ No L 193, 25. 7. 1985, p. 15., requires Member States to notify the Commission of the free-at-frontier prices of carp; whereas this requirement can usefully be included in this Regulation and Article 4 of Regulation (EEC) No 1985/74 should accordingly be deleted;Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Fishery Products,HAS ADOPTED THIS REGULATION:
Article 1This Regulation lays down the detailed rules pursuant to Articles 22 and 23 of Regulation (EEC) No 3759/92 concerning the notification of free-at-frontier prices of imports of certain fishery products.
Article 21.Member States shall notify to the Commission the free-at-frontier prices of the goods listed in Annexes I, II, III, IV and V to Regulation (EEC) No 3759/92 for which a reference price is fixed and which are placed in free circulation. This information shall be broken down by Taric code and according to the day on which the import declaration was presented.2.The free-at-frontier price shall for the purposes of this Regulation be the customs value declared.3.The requirement to notify applies only to goods released for free circulation in a representative port or market, which for the purposes of this Regulation shall be one of the points of entry listed in the Annex.4.The notification shall be sent before the 25th day of each month or the first working day thereafter for goods released into free circulation between the first and the 15th day of the month, and the 10th day of the following month or the first working day thereafter for goods released into free circulation between the 16th and the last day of the month. The notification shall be sent to the Commission by electronic mail in the form indicated in Annex II.
Article 31.Regulation (EEC) No 3191/82 is repealed.2.Article 4 of Regulation (EEC) No 1985/74 is deleted.
Article 4This Regulation shall enter into force on 1 January 1995.
This Regulation shall be binding in its entirety and directly applicable in all Member States.ANNEX I
