Article 11.This Regulation shall apply to all fisheries and related activities pursued within the territory or the maritime waters of the Mediterranean of the east of line 5° 36′ west falling under the sovereignty or jurisdiction of Member States with the exception of pools and lagoons. It shall also apply to such activities pursued in the Mediterranean outside those waters by Community vessels.2.Member States with a Mediterranean coastline may continue to legislate in the areas covered by paragraph 1, including that of non-commercial fisheries, by adopting measures supplementary to, or going beyond the minimum requirements of, the system established by this Regulation, provided such measures are compatible with Community law and in conformity with the common fisheries policy.When adopting such measures, Member States shall pay attention of the conservation of fragile or endangered species or environments, in particular those listed in Annex I.3.The Commission shall be informed, in time for it to present its observations in accordance with the procedure laid down in Article 14 of Regulation (EEC) No 3094/86, of any plans to introduce or amend national conservation and resource management measures.

Article 21.The use for fishing purposes and the keeping on board of toxic, soporific or corrosive substances, of electric shock generators and of explosives shall be prohibited.2.The use of St Andrew's crosses and similar towed gear for harvesting coral and the use of pneumatic hammers or other percussive instruments for the collection of lithophagous molluscs shall be prohibited.3.The use of encircling and towed nets set from a boat and operated from the shore (shore seines) shall be prohibited as from 1 January 2002 unless the Council, acting by a qualified majority on a proposal from the Commission, decides otherwise in the light of scientific data proving that their use does not have a negative impact on resources.

Article 31.The use of trawls, seines or similar nets shall be prohibited within three nautical miles of the coast or within the 50 m isobath where that depth is reached at a shorter distance, irrespective of the method of towing or haulage, except where a derogation is provided for in national legislation in respect of a three-mile coastal zone which extends beyond the territorial waters of a Member State.However, any fishing gear used at a distance from the coast of less than that laid down in the first subparagraph and used in accordance with national law in force on 1 January 1994 may be used until 31 December 2002, unless the Council acting by a qualified majority on a proposal from the Commission, decides otherwise in the light of scientific data proving that their use does not have a negative impact on resources.1a.The use of fishing gear under the conditions of the second subparagraph of paragraph 1 shall be prohibited, with exception of the fishery conducted with "gangui", unless the Member State concerned has enacted measures ensuring that for these fisheries:the prohibition envisaged in paragraph 3 is not jeopardised,fishing does not interfere with the activities of vessels using gears other than trawls, seines or similar towed nets,fishing is restricted to target species not subject to a minimum landing size in accordance with Article 8,fishing is restricted in such a way that catches of species mentioned in Annex IV are minimal,vessels are subject to special fishing permits issued in accordance with Council Regulation (EC) No 1627/94 of 27 June 1994 laying down general provisions concerning special fishing permitsOJ L 171, 6.7.1994, p. 7..These measures shall be communicated to the Commission before 31 December 2000.2.By way of derogation from paragraph 1, the use of dredges for catching shellfish shall be authorized irrespective of the distance from the coast and the depth, provided that the catch of species other than shellfish does not exceed 10 % of the total weight of the whole catch.3.Fishing with bottom trawls, seines or similar nets above the Posidonian beds (Posidonia Oceanica) or other marine phanerogams shall be prohibited.4.It shall be prohibited to set any type of encircling net within 300 m of the coast or within the 30 m isobath where that depth is reached at a shorter distance.

Article 3a1.It shall be forbidden to take bluefin tuna with an encircling net:for vessels whose exclusive or predominant area of operation is the Adriatic, from 1 to 31 May in the whole Mediterrean Sea and from 16 July to 15 August in the Mediterranean Sea excluding the Adriatic,for vessels whose exclusive or predominant area of operation is the Mediterranean, excluding the Adriatic, from 16 July to 15 August in the whole Mediterranean Sea and from 1 to 31 May in the Adriatic.Member States shall ensure that all vessels flying their flag or registered in them comply with this paragraph.For the purposes of this Regulation, the southern limit of the Adriatic Sea shall be a line drawn between the Albanian-Greek border and Cape Santa Maria di Leuca.2.It shall be forbidden to use airplanes or helicopters in support of fishing operations for bluefin tuna during the period 1 to 30 June.

Article 41.The Member States shall draw up a list of protected zones in which fishing activities are restricted for biological reasons specific to those zones.2.The competent authorities of the Member States concerned shall fix the list of fishing gear which may be used in protected zones, as well as the appropriate technical rules, on the basis of the relevant conservation objectives and in accordance with this Regulation.3.The measures referred to in paragraphs 1 and 2 shall be notified to the Commission, which shall communicate them to the other Member States.

Article 51.Member States shall fix restrictions involving the technical characteristics of the main types of gear in accordance with the minimum requirements set out in Annex II.2.The restrictions referred to in paragraph 1 shall be notified to the Commission in accordance with Article 1 (3).When exercising its powers in accordance with Article 14 of Regulation (EEC) No 3094/86 the Council shall take account of the characteristics of the fisheries activities peculiar to the waters in question.

Article 5a1.It shall be prohibited to fish for bluefin tuna using surface-set longlines from vessels greater than 24 m in length during the period from 1 June to 31 July each year.2.For the purposes of this Article, the applicable length shall be that defined by ICCAT, given in Annex V.

Article 61.The using and keeping on board of trawl or similar towed gear, gill net or encircling net shall be prohibited, unless the mesh size in that part of the net having the smallest meshes is equal to or greater than one of the minimum mesh sizes listed in Annex III.Any fishing gear whose minimum mesh size is smaller than one of the mesh sizes laid down in Annex III, used in accordance with the national law in force on 1 January 1994 may however be used until 31 December 2002, unless the Council acting by a qualified majority on a proposal from the Commission decides otherwise, in the light of scientific data proving that its use does not have a negative impact on resources.1a.The use of fishing gear under the conditions of the second subparagraph of paragraph 1 shall be prohibited unless the Member State concerned has enacted measures ensuring that for these fisheries:fishing is restricted to target species not subject to a minimum landing size in accordance with Article 8,fishing is restricted in such a way that catches of species mentioned in Annex IV are minimal,vessels are subject to special fishing permits issued in accordance with Regulation (EC) No 1627/94.These measures shall be communicated to the Commission before 31 December 2000.2.Mesh sizes shall be determined in accordance with the procedure laid down in Commission Regulation (EEC) No 2108/84OJ No L 194, 24. 7. 1984, p. 22..3.The length of nets shall be defined by the length of the float line. The drop of nets shall be defined as the sum of the height of the meshes (including knots) when wet and stretched perpendicular to the float line.

Article 7Member States may prohibit landings outside places specially prepared or authorized for that purpose. Where Member States adopt such measures, they must notify them immediately to the Commission, which shall inform the other Member States.

Article 81.A fish, crustacean, mollusc or other fishery product shall be deemed undersized if it is smaller than the minimum size specified in Annex IV for the relevant species.The size of fish, crustaceans and molluscs shall be measured in accordance with Article 5 (2) of Regulation (EEC) No 3094/86 unless otherwise specified in Annex IV. If more than one method of measuring size is permitted, the fish, crustacean or mollusc shall be deemed of the required size if at least one of the stipulated measurements is greater than the relevant minimum size.2.The minimum sizes for coral, sea urchins, sea squirts and sponges shall be adopted in accordance with the procedure laid down in Article 43 of the Treaty.3.Undersized fish, crustaceans, molluscs or other fishery products shall not retained on board, transhipped, landed, transferred, stored, sold, displayed or offered for sale.

Article 8a25-mile management zone around Malta1.The access of Community vessels to the waters and resources in the zone extending up to 25 nautical miles from baselines around the Maltese islands (hereinafter "the management zone") shall be regulated as follows:(a)fishing within the management zone shall be limited to fishing vessels smaller than 12 metres overall length using other than towed gears;(b)the total fishing effort of those vessels, expressed in terms of the overall fishing capacity, shall not exceed the average level observed in 2000-2001 that corresponds to 1950 vessels with an overall engine power and tonnage of 83000 kW and 4035 GT respectively.2.By way of derogation from point (a) of paragraph 1, trawlers not exceeding an overall length of 24 metres shall be authorised to fish in certain areas within the management zone, as described in Annex V, part (a), to this Regulation, subject to the following conditions:(a)the overall fishing capacity of the trawlers allowed to operate in the management zone shall not exceed the ceiling of 4800 kW;(b)the fishing capacity of any trawler authorised to operate at a depth of less than 200 metres shall not exceed 185 kW; the isobath of 200 metres of depth shall be identified by a broken line, the waypoints of which are listed in Annex V, part (b), to this Regulation;(c)trawlers fishing in the management zone shall hold a special fishing permit in accordance with Article 7 of Regulation (EC) No 1627/94 of 27 June 1994 laying down general provisions concerning special fishing permitsOJ 171, 6.7.1994, p. 7. and shall be included in a list containing their name, their international registration number and vessel characteristics to be provided to the Commission annually by the Member States concerned;(d)the capacity limits laid down in points (a) and (b) shall be periodically re-evaluated, following advice from relevant scientific bodies concerning their effects on the conservation of stocks.3.If the overall fishing capacity referred to in point (a) of paragraph 2, exceeds the overall fishing capacity of trawlers with an overall length equal to, or less than, 24 metres and operating in the management zone in the reference period 2000-2001 (hereinafter referred to as the "reference fishing capacity"), the Commission shall, in accordance with the procedure laid down in Article 10a, allocate this surplus of available fishing capacity between the Member States taking into account the interest of the Member States requesting an authorisation.The reference fishing capacity shall correspond to 3600 kW.4.Special fishing permits for the surplus of available fishing capacity referred to in paragraph 3 shall be issued only to vessels included in the Community fleet register at the date of application of this Article.5.If the overall fishing capacity of the trawlers authorised to operate in the management zone in accordance with paragraph 2(c) exceeds the ceiling laid down in paragraph 2(a), because that ceiling has been lowered after the revision provided for in paragraph 2(d), the Commission shall allocate fishing capacity between Member States on the following basis:(a)fishing capacity in kW corresponding to vessels having fished in the zone during the period 2000-2001 shall rank first;(b)fishing capacity in kW corresponding to vessels having fished at any other time in the zone shall rank second;(c)any remaining fishing capacity for other vessels shall be divided between the Member States taking into account the interests of the Member States requesting an authorisation.6.By way of derogation from point (a) of paragraph 1, vessels fishing with purse seines or longlines and vessels fishing for dolphinfish in accordance with Article 8b shall be authorised to operate within the management zone. They shall be granted a special fishing permit in accordance with Article 7 of Regulation (EC) No 1627/94 and shall be included in a list containing their name, their international registration number and vessels characteristics to be provided to the Commission by each Member State.The fishing effort shall anyhow be controlled in order to safeguard the sustainability of these fisheries in the zone.7.The master of any trawler authorised to fish in the management zone in accordance with paragraph 2 which is not equipped with VMS shall signal each entry into and exit from the management zone to its authorities and to the authorities of the coastal State.

Article 8bDolphinfish fishery1.It shall be prohibited to fish dolphinfish (Coriphaena spp.) within the management zone by fishing aggregating devices (FADs) from 1 January to 5 August each year.2.The number of vessels participating in the dolphinfish fishery within the zone shall not exceed 130.3.The Maltese authorities shall establish FAD course lines and allocate each FAD course line to Community fishing vessels at the latest by 30 June each year. Community fishing vessels flying a flag other than that of Malta shall not be authorised to operate a FAD course line within the 12-mile zone.4.Fishing vessels authorised to participate in dolphinfish fishery shall be granted a special fishing permit in accordance with Article 7 of Council Regulation (EC) No 1627/94 and shall be included in a list containing their name, their international registration number and vessels characteristics to be provided to the Commission by each Member State.Notwithstanding the provisions of Article 1(2) of Regulation (EC) No 1627/94, vessels of an overall length of less than 10 metres shall be required to have a special fishing permit.

Article 9This Regulation shall not apply to fishing operations conducted solely for the purpose of scientific investigations which are carried out with the permission and under the authority of the Member State or Member States concerned and of which the Commission has been informed.

Article 10When excercising its powers under this Regulation, and particularly when preparing proposals for measures in areas covered by agreements concluded between fishermen, the Commission shall seek the opinion of the organizations representing them.

Article 10aImplementing rules and amendmentsDetailed rules for the implementation of Articles 8a and 8b, in particular, on the criteria to be applied for the establishment and allocation of FAD course lines pursuant to Article 8b(3), shall be adopted in accordance with the procedure referred to in Article 30(2) of Council Regulation (EC) No 2371/2002 of 20 December 2002 on the conservation and sustainable exploitation of fisheries resources under the common fisheries policyOJ L 358, 31.12.2002, p. 59..

Article 11This Regulation shall enter into force on 1 January 1995.
